The attorneys-at-law at Hulgaard Advokater are subject to the supervisory and disciplinary system of the Danish Bar and Law Society and the rules on good legal practice, cf. section 126 of the Danish Administration of Justice Act. In addition, the rules of professional conduct apply. The rules particularly applicable to the practice of the legal profession can be found on the website of the Danish Bar and Law Society www.advokatsamfundet.dk.

Hulgaard Advokater has taken out liability insurance and provided a guarantee in accordance with the rules set by the Danish Bar and Law Society. The liability insurance covers all legal services, regardless of where they are provided. Our insurance company and guarantor is HDI-Gerling Forsikring (formerly Nassau Forsikring), Indiakaj 6, 1st floor, 2100 Copenhagen Ø.

Hulgaard Advokater has always wanted transparency, not only regarding our case handling but also about our fee policy. Therefore, our invoices can always be supplemented with a printout from our detailed time registration system.
To best prevent misunderstandings – especially about the nature of the task and the fee – it is our policy to draft engagement letters.

In our engagement letters, we state
• our description and understanding of the task
• expected start and completion date
• who at our firm is working on the case
• hourly rates for those involved
• fee estimates for the described task
• billing and payment terms
• information about our professional liability insurance

Often, the fee must be set within a range, allowing some flexibility. Furthermore, in our engagement letters, we must reserve the right to amend the tasks. In practice, it often turns out that as we delve deeper into the case, there may be other issues that we need to resolve. In such instances, we will strive to inform the customer if the work cannot be kept within the estimated time consumption.

Our fees are generally calculated based on time spent. Depending on the nature of the case, the fee may be adjusted during the final settlement of the case, whereby it may deviate from the time spent. The most significant parameters in this regard could be the outcome and complexity of the case, the responsibility connected with the case, and the time pressure. In case of international travel, a separate agreement will be made in each instance.
Copying, postage, scanning, telephone, and local travel are not billed. All expenses for transportation, food, accommodation, etc., are billed without a surcharge. Non-local travel is billed according to state rates.
Cases are usually billed monthly or quarterly on account. Each billing will include details of the tasks we have performed, possibly in the form of a printout from our time registration system.
In line with our principles of fee calculation based on time spent, the customer may request us to stop our assistance in the case or put it on hold at any time without notice. The case will then be billed based on the time spent at that point.

Depending on the nature of the case, we require a deposit at the start of the case. A deposit is always required for first-time customers and customers without a business location in Denmark.

In the event of a dispute concerning the fees charged by Hulgaard Advokater and/or dissatisfaction with the conduct of one of our lawyers, the customer can complain about the fee amount and/or the conduct to the Disciplinary Board of the Danish Bar and Law Society:

As of June 1, 2015, the special provisions on extended coverage for deposits on client accounts in case of loss, where a financial institution becomes insolvent, ceased. Deposits will only be covered by the general coverage up to a total of EUR 100,000, equivalent to approximately DKK 750,000. Please note that balances on client accounts are aggregated with the customer’s other accounts at the same financial institution. See more about the Deposit Guarantee Fund at www.gii.dk.
